1. Introduction

These Terms of Service ("Terms") govern your access to and use of CarScout, a vehicle search monitoring and market intelligence platform operated at usecarscout.com (the "Service"). Please read these Terms carefully before using the Service.

2. Acceptance of Terms

By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years of age to use the Service. By using CarScout, you represent that you are at least 18 years old.

3. Description of Service

CarScout provides:

  • Vehicle search monitoring: Automated scouts that track vehicle listings matching your criteria across multiple dealerships and marketplaces, with email alerts when new matches are found.
  • Market intelligence: Publicly available pages with pricing trends, inventory analysis, and market data for vehicles across the United States.

The Service aggregates data from third-party sources including dealership websites, automotive marketplaces, and public government databases. CarScout does not sell vehicles, facilitate transactions between buyers and sellers, or provide automotive advice.

4. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials secure and not share them with others
  • Accept responsibility for all activity that occurs under your account
  • Maintain only one account per person

5. Subscription and Pricing

CarScout offers paid subscription plans that provide access to vehicle search monitoring features. Current pricing is as follows:

Plans

  • Weekly: $5 per week, plus $0.75 per active scout
  • Monthly: $15 per month, plus $3 per active scout
  • Yearly: $99 per year, plus $25 per active scout per year

Billing Terms

  • Subscriptions automatically renew at the end of each billing period unless cancelled before renewal.
  • All payments are processed through Stripe. By subscribing, you also agree to Stripe's terms of service.
  • Prices are listed in US dollars and are subject to change. We will provide reasonable notice before any price changes take effect on your next billing cycle.
  • Refunds are handled on a case-by-case basis. Contact us at privacy@usecarscout.com for refund requests.

6. Free Features

Certain features of the Service are available without a subscription. Market intelligence pages, including vehicle pricing trends, inventory data, and market analysis, are publicly accessible at no cost. These free features are subject to the same Terms, including the acceptable use and intellectual property provisions below.

7. Acceptable Use

The Service is intended for personal, non-commercial use by individual car buyers. You agree not to:

  • Resell, redistribute, or sublicense any data obtained from the Service
  • Scrape, crawl, or use automated tools to extract data from the Service
  • Use bots, scripts, or other automated means to interact with the Service beyond normal browser usage
  • Impersonate another person or misrepresent your affiliation with any entity
  • Interfere with or disrupt the Service, its servers, or connected networks
  • Commercially redistribute market intelligence data, pricing trends, or inventory analytics obtained from the Service
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Use the Service in any way that violates applicable local, state, national, or international law

8. Vehicle Data and Accuracy

CarScout aggregates vehicle listing data from third-party sources. Regarding this data:

  • No guarantee of accuracy: Listing prices, vehicle details, availability, and other information may be inaccurate, outdated, or incomplete. Data comes from external sources that we do not control.
  • No guarantee of availability: Vehicles shown in the Service may have already been sold, had their price changed, or been removed from the source listing.
  • Independent verification required: Always verify vehicle details, pricing, condition, and history directly with the seller before making any purchase decision.
  • Not responsible for purchase outcomes: CarScout is a search and monitoring tool only. We are not a party to any vehicle transaction and bear no responsibility for the outcome of any purchase you make based on information found through the Service.

9. Intellectual Property

The Service, including its design, code, features, market analytics, and aggregated data presentations, is owned by CarScout and protected by applicable intellectual property laws.

  • CarScout's ownership: We retain all rights to the platform, its user interface, analytics methodologies, and any original content we create.
  • Your content: You retain ownership of the search criteria and preferences you input into the Service. By using the Service, you grant us a license to use this information to operate and improve the Service.
  • Third-party data: Vehicle listing data, specifications, and images sourced from third parties remain the property of their respective owners. Our use and display of this data is subject to our agreements with those providers.

10. Limitation of Liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law:

  • CarScout is not liable for any vehicle purchase decisions you make based on data found through the Service.
  • CarScout is not liable for the accuracy, completeness, or reliability of third-party vehicle listing data.
  • CarScout's total liability to you for any claims arising from your use of the Service is limited to the amount you paid to CarScout in the 12 months preceding the claim.
  • In no event shall CarScout be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

11. Account Termination

  • By you: You may cancel your subscription and delete your account at any time through your account settings.
  • By CarScout: We may suspend or terminate your access to the Service if you violate these Terms, engage in abusive behavior, or for any other reason at our reasonable discretion, with notice where practicable.
  • Effect of termination: Upon account deletion, your personal information will be anonymized as described in our Privacy Policy. Active subscriptions will not be renewed after the current billing period.

12. Indemnification

You agree to indemnify, defend, and hold harmless CarScout and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

13. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

In the event of a dispute arising from or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at privacy@usecarscout.com. If the dispute is not resolved within 30 days, either party may pursue binding arbitration or file a claim in small claims court in the State of Delaware.

14. Changes to Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page and, for material changes, make reasonable efforts to notify you (such as through an email or in-app notice). Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CarScout regarding your use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
